Terms and Conditions for OpenEDG Python Institute

By accessing or using the OpenEDG Python Institute website (www.pythoninstitute.org) and related services (collectively, the "Website"), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Website.

1) Who We Are

Open Education and Development Group, LLC ("OpenEDG," "we," "our," "us") provides educational content, courses, certifications, and related services through the Website.

2) Eligibility; Student & Minor Use

You must be able to form a binding contract with us, and not be barred from using the Website under applicable law. Minors may use the Website only with the consent and under the supervision of a parent or legal guardian, and subject to any additional requirements under applicable laws (e.g., COPPA in the U.S. and GDPR for minors in the EU/UK). Where parental consent is required, account creation and use must be authorized by a parent/guardian.

3) Accounts, Security, and Your Responsibilities

  • You must provide accurate information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • Notify us immediately of any suspected unauthorized use or security incident.

We strongly advise enabling multi-factor authentication (MFA) immediately after creating your account and keeping your verification methods (e.g., authenticator app, backup codes) secure and up to date.

4) Educational Services; Exams & Academic Integrity

  • Services – we may provide courses, practice materials, and certification exams. Specific program terms, exam rules, and candidate agreements may apply and are incorporated by reference.
  • Integrity – cheating, sharing exam content, using unauthorized aids, impersonation, or otherwise violating exam rules is prohibited and may result in invalidation of results, suspension, or termination.
  • Proctoring – exams may be proctored by humans and/or AI tools. Proctoring may include identity verification and monitoring for integrity (see our Privacy and Cookie Policies for details).

5) Acceptable Use

You agree not to:

  • Violate any applicable law or regulation;
  • Interfere with or disrupt the Website, servers, or networks;
  • Engage in scraping, data mining, harvesting, or automated access without written permission;
  • Upload malware or otherwise compromise security;
  • Use the Website to harass, threaten, or harm others;
  • Misuse or circumvent proctoring or exam security measures.

6) Intellectual Property

The Website, its content, assessments, trademarks, logos, software, and materials are owned by OpenEDG and/or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, modify, distribute, publicly display, or create derivative works from the Website or its content.

7) Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial educational use. Any rights not expressly granted are reserved by OpenEDG and its licensors.

8) User Content

“User Content” means any content you submit (e.g., posts, form entries, feedback). You represent that you have all rights necessary to submit User Content and that it does not infringe others’ rights or violate law. You grant OpenEDG a non-exclusive, worldwide, royalty-free license to host, use, reproduce, and display your User Content solely for operating and improving the Website and services. Nothing in this Section overrides FERPA or other educational/student data protections; see our Privacy Policy.

9) Third-Party Services & Links

The Website may link to or integrate third-party services (e.g., payment processors, proctoring, analytics, video hosting). Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party content or practices.

10) Privacy, Cookies, and Children’s Protections

Your use of the Website is subject to our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect personal data, including educational records (FERPA), children’s data (COPPA), and GDPR/UK GDPR requirements. We do not sell or share personal information for advertising or other commercial gain. Additional program- or exam-specific privacy notices may apply.

11) Fees, Payments, and Refunds

Prices, taxes, and payment terms are shown at checkout or in program terms. Payments are processed by authorized providers. Refunds, if any, are subject to the specific program or voucher terms presented at purchase.

12) Changes to the Website

We may modify, suspend, or discontinue any part of the Website at any time, including features, content, or availability. Where required by law, we will provide notice of material changes.

13) Disclaimers

The Website and services are provided “as is” and “as available.” To the fullest extent permitted by law, OpenEDG disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Website will be uninterrupted, secure, or error-free.

14) Limitation of Liability

To the fullest extent permitted by law, OpenEDG and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising from or related to your use of the Website, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid (if any) for the service giving rise to the claim during the 12 months preceding the event.

You agree to defend, indemnify, and hold harmless OpenEDG and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Website, or your infringement of any third-party right.

16) Suspension & Termination

We may suspend or terminate your access to the Website at any time, with or without notice, for conduct that we believe violates these Terms, applicable law, or risks harm to users, the Website, exams, or our operations.

17) Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflicts of laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in the United States of America to resolve any dispute arising out of or relating to these Terms or the Website, except where prohibited by law.

18) Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on the Website and update the “Last updated” date below. Your continued use after changes become effective constitutes acceptance of the updated Terms.

19) Severability; No Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

20) Assignment

OpenEDG may assign these Terms or any rights and obligations hereunder without notice. You may not assign or transfer these Terms without our prior written consent.

21) Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, program- and exam-specific terms, and any other referenced policies, constitute the entire agreement between you and OpenEDG regarding use of the Website and services.
